The Affidavit for Flame Retardant Treatments

A flameproofing affidavit typically is not in a business owner’s wheelhouse of information.  There are too many day-to-day things that need to be attended to, and if something isn’t urgent, it usually doesn’t get to occupy prime real estate in a business owner’s mind. However, this piece of paper can often be the difference between a business being able to operate or being shut down by the FDNY. Even more weighty, this affidavit can be the factor in survivors and casualties should there ever be a tragic fire. All business owners must have their facilities treated with flame repellents and have possession of a flameproofing affidavit.

This flameproofing affidavit is proof that a business location has had required items soaked or coated with fire retardants. All fabrics and other materials that aren’t in and of themselves flame resistant must be treated with flame repellents if one of the following statements also applies:

  • The items didn’t pass a previous field flame test
  • The items were already treated with fire retardants and thus need to be treated again
  • The warranty time frame for the chemicals used in the treatment process has expired (or if it’s been more than 3 years)
  • The items have been washed, dry-cleaned or handled in a manner that would require them to be treated again.

For an affidavit to be acceptable to the FDNY, it needs to be authorized by a valid C-15 Certificate of Fitness holder.  Once the business owner receives the affidavit from the flameproofing company, he has 10 days from the date of treatment to have the certificate filed with the Bureau of Fire Prevention. The business owner must also retain a copy on site. Additionally, it is the responsibility of the business owner to keep accurate records of when the treated items are washed, dry-cleaned, or receive any other handling that would compromise the effectiveness of the fire retardant treatment.

 

On the actual affidavit, you should see the following information if it is a valid affidavit:

 

1. The date the treatment was performed

2. The person who performed the treatment, his C-15 Certificate of Fitness holder number, and its expiration date

3. A comprehensive description of the materials that were treated along with a statement indicating that only authorized treatments were used

4. The field name of the chemicals, its manufacturer, and its Certificate of Approval number

5. A statement that the person who treated the items observed FDNY regulations and personally performed the field test for non-combustibility (and that the objects passed)

6. The warranty period for the chemicals
